WARRANTY
Apex Fence Company fully backs our Labor & Material with a 5 YEAR WARRANTY on all LABOR and a LIMITED LIFETIME WARRANTY on material, provided by respective Manufacturer on: Chainlink, Aluminum & Vinyl fence systems. Wood Products specifically do not have a warranty due to its natural properties. Warranties do not cover anything out of our control, such as: Acts of Nature, acts of vandalism, acts of force, violence, or fence being struck by, but not limited to: any type of balls, sticks, vehicles, lawn mowers, weed whackers, etc. A complete warranty brochure for the material can be provided upon final payment of project.
TERMS & CONDITIONS
- Proposal subject to change. All prices are quoted based on what the salesperson and Customer discuss and what the price of the materials is at the time. All prices are valid for 5 days, and may change if Proposal isn’t accepted within that time frame. Proposal may also change if Customer requests a change to the Scope of Work by adding more fence or gates, in which case Apex Fence will provide revised pricing and a Change Order for Customer signature.
- Dirt Clean Up. Standard dirt clean-up is limited to leveling and raking soil displaced during normal post-installation. Excess dirt resulting from post excavation will be left on-site. Grading large areas, or any additional clean-up services beyond the standard leveling are not included and will incur additional charges if requested.
- Finished Project. Due to uneven ground, unexpected ground material, or other conditions; the finished fence may not be perfectly level, or flush to the ground; Apex Fence Co will do its best to have fence be straight and flush to the ground, but may have gaps under the fence. Customer must choose an installation style before installation begins. If customer chooses to change installation style more than once, additional labor charges will be incurred.
- Payment. All signed Contracts are deemed valid once Customer has (1) signed the Contract and (2) made the required 50% deposit. The deposit is fully refundable for 3 business days, starting on the date the Contract is signed, 75% refundable for the following 3 business days, and non-refundable after the 6th business day. Balance is DUE in full IMMEDIATELY upon substantial completion of the project. Substantial completion is defined as: the fence in fully erected and gates are installed; the fence is fully erected but Customer needs to hold off on gates due to other work going on (new home building, landscaping, irrigation, tree, pool, etc.); the fence is erected except where the Customer wants to hold off on installing due to other work going on (new home building, landscaping, irrigation, tree, pool, etc.). Payments are considered late 3 days after completion and subject to a late fee of 10% of balance or $100; whichever is greater AND incurs an 18% per year interest fee.
- Scheduling. Once 50% deposit and signed contract are received, Apex Fence Co will place order for material. Material has different lead times at different times of the year. Apex Fence Co will communicate with Customer what the expected lead time is at the time the contract is signed, but this is just an estimate and subject to change. Apex Fence Co has no control over when Suppliers get material and can supply us with material. Once material is in Apex Fence Co’s possession, we can schedule your installation on a date that works for both Customer and Apex Fence.
- Permits. Unless otherwise agreed upon, the customer is responsible for obtaining and paying for all required permits, approvals, and inspections necessary for the fence installation. The Contractor will not begin work until all necessary permits have been secured. If the Customer requests the Contractor to obtain permits on their behalf, additional administrative fees apply ($100 + fees due to municipality).
- Work Site Prep. Unless otherwise agreed upon, Customer is responsible for having a clearing of four feet along fence line, free and clear of any brush, trees, toys, tools, sheds, etc. Customer agrees that Apex Fence Co and its employees are NOT responsible for any damage caused to anything along the fence line that was not moved or that are unmovable, such as sheds, flower beds, decorations, patios, lighting, cables, etc. Any delays or additional labor required due to inadequate site prep will result in extra charges.
- Access to Utilities. Customer agrees to allow access to water and electric to Apex Fence Co, or notify Apex Fence Co ahead of installation, if water or electric are not accessible.
- Hidden Utilities. Customer agrees that Apex Fence Co and its employees are NOT responsible for any damage caused to any hidden/underground private utilities such as: Underground sprinkler lines & wiring; Underground water lines that feed swimming pools, water features, outbuildings, etc.; Irrigation piping, French Drains, septic drainage areas, etc.; Any electrical, water, gas, phone, fiber optic, or cable feeds for which the Markout Company (811) did not locate, or marked incorrectly.
- Sprinkler Lines & Repairs. Every reasonable effort will be made to avoid damage to sprinkler lines and sprinkler heads, however, this is not always possible. In case a sprinkler line is broken, Apex Fence Co will dig out the broken line and leave it exposed for Customer to have repaired at CUSTOMER’S EXPENSE.
